MEMBERSHIP TERMS & CONDITIONS
Effective Date: July 2026
These Terms & Conditions apply to all memberships, class packs, personal training sessions, studio sessions and services provided by MK1 Gym Ltd, including MK1 Gym, MK1 Studio and REMKE Studio.
By purchasing a membership, class pack, booking a class, using our facilities or accessing our services, you confirm that you have read, understood and agree to be bound by these Terms & Conditions.
- ABOUT THESE TERMS
1.1 These Terms & Conditions form the agreement between you and MK1 Gym Ltd and govern your use of all facilities, memberships, classes, coaching sessions, studio sessions and digital services operated by MK1 Gym Ltd.
1.2 These Terms apply to all services provided by:
- MK1 Gym Ltd
- MK1 Gym Studio
- Remke Studio
unless expressly stated otherwise.
1.3 These Terms replace all previous versions published by MK1 Gym Ltd & Remke Studio.
1.4 We reserve the right to amend these Terms & Conditions where reasonably necessary, including where changes are required due to legislation, operational requirements, technology or business improvements.
Where changes materially affect your membership or rights, we will provide reasonable notice via email, via our website or the MK1 Gym App.
Continued use of our facilities or services after any changes have taken effect constitutes acceptance of the updated Terms.
1.5 MK1 Gym Ltd reserves the right to amend these Terms & Conditions at any time. Any revised Terms & Conditions will be published on our website and/or made available through the Booking System. The revised Terms & Conditions will take effect from the stated Effective Date. Continued use of our facilities, services, memberships, or Booking System after the Effective Date constitutes acceptance of the revised Terms & Conditions.
- DEFINITIONS
Throughout these Terms:
“We”, “Us” and “Our” means MK1 Gym Ltd.
“You” and “Your” means the individual purchasing or using a membership, class pack or service.
“Facility” means MK1 Gym, MK1 Studio, REMKE Studio and any associated areas operated by MK1 Gym Ltd.
“Membership” means any active membership offered by MK1 Gym Ltd.
“Class Pack” means any prepaid package of classes.
“Studio Class” means any instructor-led class delivered by MK1 Studio or REMKE Studio.
“Booking System” means the MK1 Gym App, MK1 Gym Glofox platform or any future booking platform used by MK1 Gym Ltd.
“Strike” means a booking penalty automatically applied following a late cancellation or failure to attend an MK1 Studio class.
- MEMBERSHIP ELIGIBILITY
3.1 Members must be at least 16 years of age unless participating in a supervised programme specifically designed for younger participants.
3.2 All memberships are personal to the named member and may not be shared, transferred or assigned.
3.3 Any attempt to allow another individual to access the facility using your membership, app or digital access credentials may result in immediate suspension or termination of your membership.
3.4 We reserve the right to refuse or terminate membership where we reasonably believe continued membership could compromise the safety, wellbeing or enjoyment of our staff or members.
- MEMBERSHIPS
4.1 Membership Types
Membership options may include:
- Monthly Membership
- 12 Month Membership
- Pay As You Go Membership
- Class Packs
- Class Passes
- Promotional Memberships
- Corporate Memberships
The benefits, pricing and conditions applicable to each membership are detailed at the point of purchase.
4.2 Memberships commence on the agreed start date.
4.3 Membership benefits apply only whilst payments remain up to date.
4.4 Certain memberships may include unlimited access to specified facilities or classes. Unlimited access is subject to our fair usage policy and booking rules.
4.5 Memberships and class packs have no cash value and may not be exchanged for cash.
- DIGITAL MEMBERSHIP, APPS & ACCESS
5.1 Members are required to use the MK1 Gym App or any successor platform for managing bookings, memberships and communications.
5.2 Gym access may be provided through digital access systems including Kisi or any replacement access platform.
5.3 Members are responsible for maintaining the security of their login credentials and digital access.
5.4 Digital access must never be shared with another individual. Any misuse of access systems may result in immediate suspension of membership.
5.5 Members are responsible for ensuring that bookings and cancellations have been successfully processed. Failure to receive an email, text message or push notification does not invalidate any booking or cancellation policy.
5.6 Technical issues affecting a member’s personal mobile device, internet connection or email account do not exempt the member from these Terms & Conditions.
- HEALTH DECLARATION & MEDICAL QUESTIONNAIRE
Your health and safety are our priority. Whilst our instructors are highly qualified, only you and your healthcare professional can determine whether exercise is appropriate for you.
6.1 Before attending any class or using our facilities, every member must complete our Medical Questionnaire honestly and accurately.
6.2 Completion of the Medical Questionnaire is a condition of membership and participation. Failure to complete this questionnaire may result in refusal of entry until the required information has been provided.
6.3 It is entirely the member’s responsibility to ensure that all medical information supplied remains accurate and up to date.
6.4 Members must immediately notify us and update their Medical Questionnaire if there is any change to their health, including but not limited to:
- Pregnancy
- Surgery
- Injury
- Illness
- Changes to medication
- Musco skeletal conditionals
- Cardiovascular conditions
- Neurological conditions
- Respiratory conditions
- Any condition that could affect safe participation
6.5 By attending any class or using any MK1 Gym Ltd facility you confirm that:
- your Medical Questionnaire is complete and accurate;
- you are medically fit to participate
- you have sought appropriate medical advice where necessary
- you accept responsibility for exercising within your own physical capabilities.
6.6 If at any time we reasonably believe participation may place you or others at risk, we reserve the right to refuse participation until appropriate medical clearance has been obtained. Such decisions are made solely in the interests of safety.
- HEALTH, SAFETY & PARTICIPATION
7.1 Participation in all exercise is voluntary. Whilst every reasonable effort is made to provide a safe training environment, exercise carries an inherent risk of injury.
7.2 Members agree to exercise responsibly and follow all instructions provided by coaches and instructors.
7.3 Members must immediately stop exercising if they experience pain, dizziness, chest discomfort, shortness of breath beyond normal exercise intensity or any other concerning symptoms.
7.4 Appropriate clothing and footwear must be worn at all times. Grip socks must be worn for all REMKE Reformer classes unless otherwise advised.
7.5 Members must treat all equipment with care and report any damage immediately. Members must not attempt to use equipment they are unfamiliar with without first seeking assistance.
- BOOKING CLASSES
8.1 Classes are available to book through the MK1 Gym App and are subject to availability.
8.2 Bookings operate on a first-come, first-served basis.
8.3 A booking is only confirmed once it appears within your app.
8.4 Bookings are personal and may not be transferred to another person.
8.5 We reserve the right to limit bookings where necessary to ensure fair access for all members.
8.6 Late arrival may result in refusal of entry where joining the class would compromise safety, disrupt the session or disadvantage other participants.
- CANCELLATIONS, WAITING LISTS & BOOKING POLICIES
9.1 Our Booking Commitment: Our classes operate with limited capacity to provide every member with the best possible experience. Late cancellations and non-attendance prevent other members from accessing available spaces.
To ensure fairness for all members, the following booking policies apply to every class booked through the MK1 Gym App.
9.2 24-Hour Cancellation Policy
Members may cancel any class without penalty up to 24 hours before the scheduled class start time.
Any cancellation made within 24 hours of the class start time, or failure to attend a booked class, will result in the applicable booking penalty detailed below.
This policy applies regardless of the reason for cancellation, including but not limited to:
- Illness
- Injury
- Work commitments
- Family commitments
- Childcare issues
- Transport disruption
- Holidays
- Personal circumstances
Exceptions may be made solely at the discretion of MK1 Gym Ltd and will only be considered in exceptional circumstances.
9.3 Member Responsibility
It is the responsibility of every member to:
- Manage their own bookings.
- Cancel classes within the required notice period.
- Ensure cancellations have been successfully processed.
- Check booking confirmations within the App.
Failure to receive an email, push notification or reminder does not invalidate this policy.
Technical issues affecting a member’s mobile phone, internet connection or email account do not exempt the member from these Terms.
- WAITING LISTS
10.1 Where a class is fully booked, members may join the waiting list.
10.2 If a place becomes available, the Booking System will automatically notify you by email. Any available place will be allocated on a first-come, first-served basis, and your space is not guaranteed until you have successfully completed the booking through the Booking System.
10.3 Once a member has been moved from the waiting list into the class, the booking is considered confirmed and these Terms & Conditions immediately apply.
10.4 Members are responsible for monitoring their booking status.
- MK1 STUDIO STRIKE POLICY
11.1 The Strike Policy exists to ensure fair access to classes and to discourage late cancellations and repeated non-attendance.
11.2 One Strike will automatically be issued where a member:
- Cancels within24 hours of the class start time, or
- Fails to attend a booked class without cancelling.
11.3 Strikes are issued automatically through our booking system.
11.4 Strikes remain active for one calendar month from the date they are issued.
11.5 If a second Strike is received before the first Strike expires, the member may be removed from all future MK1 Studio bookings for the remainder of that calendar month.
11.6 If a third Strike is received before earlier Strikes expire, the member may be suspended from booking MK1 Studio classes for one calendar month.
11.7 Strike decisions are automated and are considered final unless an administrative error has occurred.
Requests for Strike removal will only be considered where clear evidence exists that the Strike was issued incorrectly.
- REMKE STUDIO CLASS CREDIT POLICY
12.1 REMKE Studio class packs and memberships operate using class credits.
12.2 Where a booking is cancelled at least 24 hours before the scheduled class start time, the class credit will automatically be returned to the member’s account.
12.3 Any cancellation made within 24 hours of the class start time, or failure to attend a booked class, will result in the class credit being forfeited.
12.4 Forfeited class credits cannot be refunded, transferred or reinstated except where an administrative error has occurred or at the sole discretion of REMKE Studio.
- CLASS PACKS
13.1 Class Packs are valid for the period stated at the time of purchase. Unused sessions expire automatically at the end of the validity period.
13.2 Expired Class Packs cannot be extended unless required by law or at the sole discretion of MK1 Gym Ltd.
13.3 Class Packs are personal to the named purchaser and may not be transferred, sold or shared.
13.4 Class Packs are non-refundable once purchased except where required by consumer legislation.
- MEMBERSHIP PAYMENTS
14.1 Membership fees are payable in accordance with your chosen membership.
14.2 Monthly memberships are collected by Direct Debit on the agreed collection date.
14.3 Where a member joins part-way through a payment cycle, a pro-rata payment may be taken before the first Direct Debit.
14.4Members are responsible for ensuring sufficient funds are available for collection.
14.5 Failed or returned Direct Debits may incur an administration charge of £10.00 per transaction.
Continued failure to make payment will result in termination of membership.
14.6 Outstanding balances must be settled before access to facilities or classes is reinstated.
- MEMBERSHIP CHANGES
15.1 Members wishing to upgrade, downgrade or change membership should contact our team.
Changes will take effect from the next available billing period unless otherwise agreed.
15.2 Promotional memberships may not be eligible for transfer to alternative membership types.
- FREEZING MEMBERSHIPS
16.1 Where available, memberships may be frozen at our discretion. Minimum and maximum freeze periods may apply.
16.2 Medical evidence may be requested where a freeze is requested due to illness or injury.
16.3 Membership payments and expiry dates may be adjusted to reflect any approved freeze period.
- CANCELLING YOUR MEMBERSHIP
17.1 Rolling Monthly Memberships may be cancelled by providing at least 30 days’ written notice to: info@mk1gym.co.uk
17.2 Notice periods begin from the date written notice is received.
17.3 Membership fees remain payable throughout the notice period.
17.4 All memberships are non refundable once they have commenced.
17.5 Cancelling your membership does not automatically cancel any outstanding payment obligations.
- CHANGES TO CLASSES & SERVICES
18.1 We continually review our timetable, instructors and services to ensure the highest possible experience.
18.2 We reserve the right to:
- Amend class timetables
- Change instructors
- Change class formats
- Substitute equipment
- Close facilities for maintenance
- Cancel classes where necessary
18.3 Where reasonably possible, advance notice will be provided.
18.4 If we cancel a paid class, an alternative booking, class credit or refund will be offered where appropriate.
The cancellation of a class does not entitle members to compensation beyond the value of the affected booking.
- ACCESS TO OUR FACILITIES
19.1 Members may access MK1 Gym, MK1 Studio and REMKE Studio in accordance with their membership entitlement and our published opening hours.
19.2 Access is provided using our digital access systems. Members are responsible for keeping their access credentials secure and must not share them with any other person.
19.3 We reserve the right to temporarily restrict access to all or part of our facilities for maintenance, repairs, events, cleaning, staff training or operational reasons.
Where reasonably practicable, advance notice will be provided.
19.4 Temporary closures or restricted access do not automatically entitle members to refunds, extensions or compensation.
- CODE OF CONDUCT
We are committed to providing a welcoming, inclusive and respectful environment for every member of our community.
By joining MK1 Gym Ltd you agree to behave in a manner that supports this environment.
20.1 Members must:
- Treat all staff, coaches and members with courtesy and respect.
- Follow all reasonable instructions given by staff.
- Respect equipment and facilities.
- Maintain appropriate personal hygiene.
- Wear suitable clothing and footwear.
- Exercise responsibly and safely.
20.2 Members must not:
- Abuse, intimidate or harass staff or other members.
- Use threatening, discriminatory or offensive language.
- Damage equipment intentionally or through misuse.
- Train whilst under the influence of illegal drugs.
- Bring illegal substances or weapons onto our premises.
- Film or photograph others without their consent
- Allow another person to use their membership or access credentials.
20.3 We operate a zero-tolerance policy towards abusive, aggressive, intimidating or discriminatory behaviour.
Any such behaviour may result in immediate removal from the premises and termination of membership without refund.
- PERSONAL TRAINING & THIRD-PARTY SERVICES
21.1 Personal Trainers operating within MK1 Gym are self-employed and operate independently.
21.2 Contracts, payments and agreements entered into directly with a Personal Trainer are between you and that individual unless otherwise stated. MK1 Gym Ltd accepts no responsibility for services provided independently by third-party coaches or practitioners.
- EQUIPMENT & FACILITY USE
22.1 Members must use all equipment in accordance with manufacturer guidance and any instruction provided by staff.
22.2 Members must immediately report any damaged or faulty equipment.
22.3 Equipment must not be deliberately misused.
22.4 Where damage occurs through deliberate misuse or negligence, we reserve the right to recover reasonable repair or replacement costs.
- CHILDREN & FAMILY CLASSES
23.1 Children may only enter designated areas where permitted.
23.2 During any ‘Bay & Me’ classes, parents and guardians remain entirely responsible for their child at all times.
23.3 Children participating in designated classes must meet any published age requirements.
23.4 We reserve the right to refuse participation where we reasonably believe a class is unsuitable for either parent or child.
- PHOTOGRAPHY, FILMING & SOCIAL MEDIA
24.1 From time to time we may capture photographs or video within our facilities for marketing, promotional and educational purposes.
24.2 Where individuals are clearly identifiable, we will always seek appropriate consent wherever reasonably practicable.
24.3Members who do not wish to appear in promotional content should notify a member of staff.
We will make every reasonable effort to respect those wishes.
24.4 Members must respect the privacy of others and should not photograph or film other members without their permission.
- CCTV & SECURITY
25.1 For the safety and security of our members, staff and premises, CCTV operates throughout parts of our facilities.
25.2 Images are processed in accordance with UK data protection legislation.
25.3 CCTV may be used for the prevention and detection of crime, investigation of incidents and protection of members, staff and property.
- LOST PROPERTY
26.1 All personal belongings remain the responsibility of the owner.
26.2 Items left within our facilities may be retained for a reasonable period before being donated, recycled or disposed of.
26.3 Whilst reasonable care is taken, MK1 Gym Ltd accepts no responsibility for lost, stolen or damaged personal belongings unless caused by our negligence.
- LIMITATION OF LIABILITY
27.1 Participation in exercise and use of our facilities is entirely voluntary and carries an inherent risk of injury.
27.2 By attending our facilities you acknowledge and accept these inherent risks.
27.3 Nothing within these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or any other liability which cannot legally be excluded.
27.4 Subject to Clause 27.3, MK1 Gym Ltd shall not be liable for:
- Loss of earnings.
- Loss of opportunity.
- Consequential or indirect loss.
- Damage to personal property.
- Injury arising from misuse of equipment.
- Injury resulting from failure to disclose relevant medical information.
27.5 Members are responsible for exercising within their own physical capabilities and for seeking appropriate medical advice where necessary.
- DATA PROTECTION
28.1 We process personal information in accordance with UK GDPR and the Data Protection Act 2018.
28.2 Information collected may include:
- Contact details.
- Emergency contact information.
- Medical questionnaire information.
- Membership records.
- Attendance records.
- Payment information.
28.3 Your information is used only for legitimate business purposes, including providing services, maintaining safety and complying with legal obligations.
28.4 Our full Privacy Policy is available on our website.
- FORCE MAJEURE
29.1 We shall not be responsible for any delay, interruption or failure to perform our obligations where caused by circumstances beyond our reasonable control.
Examples include, but are not limited to:
- Extreme weather
- Fire
- Flood
- Pandemic
- Government restrictions
- Industrial action
- Failure of technology providers
- Acts of terrorism
Where reasonably possible we will endeavour to minimise disruption.
- OUR RIGHT TO REFUSE OR TERMINATE MEMBERSHIP
30.1We reserve the right to refuse, suspend or terminate membership where a member:
- Breaches these Terms & Conditions;
- Shares membership or digital access;
- Fails to make payment
- Behaves in a manner likely to endanger themselves or others
- Commits criminal or anti-social behaviour on our premises;
- Causes deliberate damage to equipment or facilities;
- Acts in a way that may bring MK1 Gym Ltd or REMKE Studio into disrepute.
30.2 Where appropriate, we may suspend membership whilst investigating any alleged breach.
- COMPLAINTS
31.1We are committed to delivering an exceptional experience.
If you have a concern, we encourage you to speak with a member of the team at the earliest opportunity.
31.2 Formal complaints should be submitted in writing to:info@mk1gym.co.uk
We aim to acknowledge complaints promptly and investigate them fairly.
- GENERAL PROVISIONS
32.1 If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall continue in full force and effect.
32.2 Failure by MK1 Gym Ltd to enforce any provision shall not constitute a waiver of our rights.
32.3 These Terms constitute the entire agreement between MK1 Gym Ltd and the member relating to membership and use of our facilities.
- GOVERNING LAW
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
